Early Termination Fees (ETF)
Gyms often charge $100-$300 to cancel a 12-month contract early. Is it legal? Usually yes, if you agreed to it.
How to waive it: You can typically avoid the ETF if:
- You have a medical disability (Doctor's note required).
- You move more than 25 miles away from any gym location.
- The gym closed essential facilities (e.g., the pool or childcare you signed up for).
The "Moving" Clause
Most states have "Health Club Statutes" that mandate your right to cancel if you move.
Standard Proof Required:
- New utility bill (water, electric) in your name.
- New lease agreement or deed.
- Updated driver's license.
Send a copy of one of these documents with your cancellation letter.
Unexpected Price Hikes
Did your $20/month membership suddenly become $30? Check your contract.
- Fixed Term (12 months): They usually cannot raise the price until the term ends.
- Month-to-Month: They can raise the price, but usually must give you 30–60 days written notice. If they didn't, you can dispute the increase.
"I lost my contract"
Gyms count on you losing it. You have the right to request a copy at any time.
Email them: "Please send a complete copy of my signed membership agreement, specifically highlighting the cancellation terms, pursuant to [Your State's] Consumer Protection Laws."
